- State the Issue
- What is the legal question that, when answered, determines the legal result of the case? What are the parties disputing and what do they want the court to decide?
- The issue should be stated in the form of a question in a specific, rather than a general form.
- If there is more than one issue to address, then you must write a separate IRAC analysis for each issue.
- 1. Identify the Rule
- What law or test applies to the issue?
- The rule should be stated as a general principle and not a conclusion to the particular case.
- 2. Conduct an Analysis
- Apply the rule to the facts of the case. What are the relevant facts given the rule of the law?
- Use the facts to explain how the rule leads to the conclusion. How does the court interpret the rule?
- Discuss both sides to the case.
- 3. State the Conclusion
- The conclusion should be stated in one or two sentences. The rationale should not be longer than a paragraph.
- Do you agree with the court's rulings thus far? Explain your answer.
- 4. Answer the following questions.
- If you were the judge in this case, how would you rule? Provide the rationale for your answer.
