What is an example of a situation within the medical field where you need to know the law? Consider situations such as emergency room patients and violence victims.

As you respond to your classmates, discuss the potential legal consequences of not knowing the law in that situation.

Please include the name of the person or question to which you are replying in the subject line. For example, "Tom's response to Susan's comment."

Tara:

I can think of two very common incidents in healthcare where you need to know the law especially working in an emergency room setting. Reporting abuse (nonaccidental injuries to patients) this includes adults and children. Anyone involved in the care of the patient is responsible for reporting possible abuse, these include physicians, nurses, security and any other personnel employed by the medical facility. An oral report can be given immediately in person or by phone and followed up by a written report. Law enforcement should be contacted immediately with details of the incident. All medical personnel will be immune from any liability. This law is very important to know in healthcare and happens more often than you think especially in elderly adults, it does not always involve family members most of the time it is paid, caregivers. Domestic violence cases must also be reported to law enforcement.

Informed consent in medical care is very important and the importance cannot be stressed enough. Informed consent means that a medical professional must tell the patient all of the potential benefits, risks, and alternatives involved n any surgical procedure, medical procedure and any other course of treatment, and must obtain the patient or patients' guardian written consent to proceed. The reason for this is to make sure the physician follows through on the duty to disclose information to the patient so they can make a reasonable decision regarding procedure or treatment. Consent is not required in an emergency if a physician deems an emergency medical care can be given without consent. This law is very important to know, never hold up saving someone's life in a life-threatening situation because of written consent.  Informed consent for medical treatment is fundamental in both ethics and law. The real importance is to know when you must have one to treat and when to treat without one.
