Children are entitled to support from both parents. There are times when the non-custodial parent does not want to pay the funds directly to the custodial parent, or the non-custodial parent wants to control how the money is being spent. When these situations occur, often times the Courts must intervene. The process that is to be followed is addressed in the following question. Is there a significance to the fact that this is only a “temporary” order? What are the other types of orders? Further, read the scenario below and answer the following questions too.

Dawn and Tony had a child together but were never married. They live in Nebraska. Dawn and Tony separate. Dawn files for child support and receives a temporary order for child support of $50 per week. Tony refuses to make child support payments because he feels he does not need to support the child. Can Dawn enforce a temporary order for child support? If so, what procedures should she follow? Discuss your reasoning.

Justify your ideas and responses by using appropriate examples and references from Westlaw (including primary sources such as cases, statutes, rules, regulations, etc.), government websites, peer-reviewed legal periodicals (not lawyer blogs), which can be supplemented by law dictionaries or the textbook. This means you need to use more than just your text and legal dictionaries.
