1.The impact of shows like CSI from a different angle in this follow-up question. Many people automatically assume that shows like CSI work to the advantage of the defense because it creates a scenario where jurors expect detailed crime lab evidence analysis and when that is absent, they may be less likely to convict an individual.

 Is it not also possible that this juror expectation could work in the prosecutions favor by creating a scenario where jurors are easily convinced of an individual's guilt just because a crime lab report appears to indicate the accused was involved in the crime? In other words, have we entered a realm where jurors are so reliant on what crime lab results appear to show that they no longer consider other factors in a case that might indicate a defendant is innocent? Explain your position.

 

 

 

2. Probation and Parole Officer. The offender must consent to a warrantless search of their person, vehicle, or residence at the request of their officer. The Probation and Parole Officer did not have to obtain a warrant from the court to conduct the search. Instead the only requirement was that the officer has a suspicion that the offender might have something that violates the law in their possession.

 

 

What are your thoughts on this condition of probation and parole with respect to the Fourth Amendment? Does it violate the Fourth Amendment or have offenders that agree to supervision as opposed to incarceration waived their constitutional rights in this area?
